K arachi: Renowned Jurists said that the government decision not to file appeal against Supreme Court verdict in contempt case against Prime Minister Yusaf Raza Gilani is a political decision.

Jutice (R) Fakhruddin Din G. Ibrahim talking to saach.tv said that since the Speaker of National Assembly has decided not to disqualify Prime Minister Gilani by sending the reference to the Election Commission, therefore there is no need for Government to file the Intra Court appeal. Moreover, he said that filing the appeal might go against them.

He said that judgment of Supreme Court declared  the Prime Minister convicted of contempt charges and the conviction was also recorded but there is no direction of disqualification of the Prime Minister mention in the  verdict.

Answering a question,  about challenging Dr. Fehmida’s decision  in Supreme Court, he commented that it is not possible, as the Constitution provides her protection.

“She is answerable to the parliament not to the court,” he added.

He said that the case of  Prime Minister ’s eligibility has been closed after the ruling of Speaker Dr. Fehmida Mirza.

Talking to saach.tv, Justice (R) Tariq Mehmood said that the Government decision against appeal is totally political and does not hold any legal value.
